各省、自治区、直辖市及计划单列市、新疆生产建设兵团发展改革委:
为认真贯彻落实中发[2007]1号文件精神,切实加强对各地现代农业建设的指导,我委在各省(市、区)现代农业建设相关规划的基础上,委托编制了《现代农业示范项目建设规划(2007-2010年)》,现印发给你们,请按照规划明确的指导思想、基本原则、建设目标、区域布局和建设重点,抓紧修改和完善本地现代农业建设相关规划,加强示范项目储备,精心组织实施,强化项目管理,坚持体制机制创新,更好地发挥现代农业示范项目在转变农业增长方式、促进农业结构调整、增加农民收入方面的典型引导和辐射带动作用,扎实稳步推进社会主义新农村建设。

现代农业示范项目建设规划(2007-2010年)


为加快推进我国现代农业发展,探索不同地区现代农业建设的有效途径,加快农业增长方式转变,促进农业结构调整和增加农民收入,夯实社会主义新农村建设的产业基础,根据党的十六大和十六届三中、四中、五中全会精神,以及国民经济和社会发展“十一五”规划纲要的有关要求,在认真总结近年来现代农业示范项目建设的基础上,依据各省(区、市)现代农业示范项目建设相关规划,制定本规划。
本规划执行期限为2007-2010年。
一、进一步加强现代农业示范项目建设的重要意义
推进社会主义新农村建设,促进农村和谐,首要任务是发展现代农业。推进现代农业建设,顺应我国经济发展的客观规律,是促进农业结构调整的必然要求,是增加农民收入的基本途径,是提高农业综合生产能力的重要举措,是建设社会主义新农村的产业基础。建设现代农业,必须用现代物质条件装备农业,用现代科学技术改造农业,用现代产业体系提升农业,用现代经营形式推进农业,用现代发展理念引领农业,用培养新型农民发展农业,着力提高农业的水利化、机械化和信息化水平,提高土地的产出率、资源利用率和农业劳动生产率,提高农业的素质、效益和竞争力,加快发展农村生产力,切实转变农业增长方式,促进农业又好又快发展。
现代农业示范项目建设,是引导和鼓励广大农民与社会力量投资现代农业建设的有益尝试,是构建现代农业产业体系的重要环节,是加快推进我国农业现代化建设进程的重大举措。开展现代农业示范项目建设,对于充分发挥政府投资的导向性和示范作用,促进各地优势农业资源合理开发和有效利用,提升农业产业化经营水平和农业整体素质,加快开发农业多功能性和拓展农业发展新领域,引导和带动农民增收致富,探索不同地区现代农业发展道路和模式,提高我国农业现代化水平和农产品市场竞争力,都具有十分重要的作用。
二、“十五”期间现代农业示范项目建设的主要成效和存在的问题
为加快推进农业增长方式转变,积极探索我国不同地区农业现代化建设的有效途径,1998年以来,特别是“十五”期间,国家发展改革委每年都从中央预算内投资中安排专项资金,支持各地建设了一批立足当地优势农业资源开发、推进农业产业化经营的现代农业示范项目,并取得了明显成效。一是紧紧围绕各地优势农业资源,把优势主导产业、特色农业发展与现代农业示范项目建设有机结合起来,充分发挥项目的科技先导和示范带动作用,极大推动了促进优势产业的发展;二是充分依托地方科研院所的力量,走产学研、农科教结合的路子,通过优质新品种引进、繁育和推广,大大促进了农业的优质化进程,实现了以科技促进农业产业的发展;三是通过项目建设,成功地带动了一批以专业化、规模化、基地化、商品化为主要内容的各具特色的产业基地的快速发展,促进了农业结构调整和农民增收;四是注重把先进的生产经营方式和管理理念引入农业领域,项目建设以市场为导向,按照市场经济规律进行运营和管理,坚持在体制机制上创新,实行市场化经营、企业化运作的现代企业管理制度,体现了现代农业的发展方向;五是充分发挥政府投资的导向和示范作用,通过建设生产基地,改善基础设施条件,引导信贷资金、民间资本和外资投资现代农业建设,鼓励农民投身项目建设,拓宽了现代农业建设的资金来源;六是示范项目已经成为当地农业科技人员及广大农民参观学习和培训的重要基地,成为展示现代农业新技术和新成果的重要窗口,成为探索不同区域现代农业发展道路的试验区。
当前存在的主要问题是,一些地区对现代农业建设的重视程度还不够,尚未明确现代农业建设的总体思路,项目建设缺乏规划的统筹指导;示范项目的建设范围和领域还需进一步拓展,部分示范项目的辐射和带动作用还需进一步增强,等等。以上问题,急需通过科学规划,进一步加强现代农业示范项目建设加以解决。
三、现代农业示范项目建设的指导思想、基本原则和建设目标
(一)指导思想。全面贯彻落实科学发展观,按照全面建设小康社会、构建社会主义和谐社会的总体要求,紧紧围绕“十一五”规划纲要提出的建设现代农业的重大历史任务,以转变农业增长方式为核心,以促进农业结构调整和增加农民收入为目标,将现代农业建设作为贯穿新农村建设和现代化全过程的长期艰巨任务,调整和完善现代农业示范项目建设基本思路,明确项目目标定位,拓宽农业项目的多功能性,创新管理体制和运行机制,提高项目组织管理和经营水平,促进农业结构调整和产业优化升级,发挥示范项目对推进现代农业建设的引导、带动和辐射作用,为社会主义新农村建设夯实产业基础。
(二)基本原则。现代农业示范项目建设应遵循以下主要原则:
——城乡统筹发展原则。把发展现代农业与推进农村工业化、城镇化和社会主义新农村建设结合起来,通过项目建设,推进农业现代化建设进程。
——发挥区域优势原则。从实际出发,因地制宜,发挥各地资源、气候和区位优势,优化农业区域布局,发展壮大优势产业,把项目建设与发展优势农业、特色产业紧密结合起来,推动重点地区发展和优势产业开发。
——市场导向原则。坚持以市场为导向,以效益为中心,重点发展市场前景广阔、产业覆盖面大、对农民增收效果明显的农业产业。按照市场经济规律进行运营和管理,实行市场化经营,企业化运作,坚持经济效益与社会效益的统一。
——科技先导原则。综合运用现代农业科技成果、现代农业生产手段和现代经营管理方式,加强新品种新技术引进和推广,促进主导产业升级,提高农产品档次和质量,实现农业经济与现代科技的有机结合,提升农产品竞争力。
——易于推广原则。现代农业示范项目既要保持领先性,又要具有可推广性。示范是指技术、资本、经营方式、发展理念在内的全方位示范。推广是指项目建设既有适当超前性,又能在面上得到广泛应用,带动当地产业升级和现代化建设。
——多元化投入原则。项目建设以地方投入为主、中央适当补助,引导和鼓励广大农民与社会力量积极投资现代农业建设。中央补助投资体现导向性,突出公益性和基础性,发挥农民在发展现代农业中的主体作用。
——体制机制创新原则。现代农业示范项目是新时期探索我国发展现代农业的一项基础性工程,带有一定的试验示范性质。要通过大胆探索,创新体制机制,完善管理模式,增强发展活力,发挥示范带动作用,总结适合不同地区农业现代化实现途径。
(三)建设目标。“十一五”期间,中央继续安排专项投资,带动地方政府投资、信贷资金和民间资本,在全国扶持一批特色明显、布局合理、技术先进、投入集约、规模适度、管理水平高、体现不同地区现代农业发展方向的示范项目。通过项目建设,使农产品良种率明显提高,农业优质化标准化水平稳步发展,农业资源节约迈出较大步伐,农业科技创新能力明显增强,农业多功能性初步得到发挥,逐步形成专业化生产、产业化经营、社会化服务、科学化管理的现代农业格局,促进农业结构调整和农业增长方式转变,提高农村生产力水平和农民增收,为加快不同区域现代农业建设进程发挥辐射和带动作用。
四、区域布局、建设重点和项目类型
我国地区间的资源环境条件和农业发展水平存在很大差异,现代农业示范项目建设必须坚持区别对待、分类指导,围绕优势和特色,因地制宜地确定各地现代农业示范项目建设重点。
东部沿海发达地区和大城市郊区。注重发挥经济实力强、外向程度高等优势,重点发展出口创汇农业、精品农业、都市农业和观光旅游农业等。规划范围为:北京、天津、河北、辽宁、山东、江苏、上海、浙江、广东、福建、海南等11省、直辖市,以及大连、青岛、宁波、厦门、深圳等5个计划单列市。
中部地区。依托粮棉等大宗农产品生产优势,以加强农业基础设施建设和良种良法示范为突破口,大力发展粮棉油深加工项目和健康养殖业,提高农业产业化经营水平,提高农产品附加值和效益。规划范围为:山西、黑龙江、吉林、河南、湖南、湖北、江西、安徽8省。
西部地区。发挥气候地质类型独特和资源丰富的优势,扶持具有区域优势的特色农业,围绕农业资源综合开发和持续利用,大力支持绿色有机农业和生态旅游农业发展,发展生物质原料种植,重点建设名特优稀农业产业化示范项目。规划范围为:内蒙古、广西、重庆、四川、贵州、云南、西藏、陕西、甘肃、青海、宁夏、新疆等12个省、自治区、直辖市及新疆生产建设兵团。
中央补助投资重点支持以下五类示范项目:一是特色农业发展项目。围绕本地优势农业资源综合开发,扶持特色农业发展,建立特色农产品生产基地,壮大特色产业龙头企业实力,发展“龙型”经济。二是外向型农业示范项目。促进农业扩大对外开放和出口,发展设施农业、绿色食品和有机食品,提高农产品的国际竞争力和出口创汇能力,加快外向型农业的发展。三是农业适用新技术综合应用项目。应用国内外先进技术,开发具有自主知识产权的优势品种和先进工艺,对农业新技术开展组装配套和适用推广,促进科技成果的转化等,加快农业技术进步。四是农业可持续发展项目。大力发展优质高效低耗农业,发展循环农业,开发利用生物质能源等关键技术,保护生态环境。五是农业多功能性拓展项目。支持观光休闲和文化传承等项目发展,向农业的广度和深度进军,促进农业多功能性开发。
五、项目资金来源及中央投资支持方式
现代农业示范项目的投资构成分为:中央补助投资、地方补助投资、企业自有资金和其他投资四个部分。中央投资性质为中央补助地方投资,按照《中央预算内投资补助和贴息项目管理暂行办法》(国家发展和改革委员会第31号令)进行管理。在补助投资安排上,严格执行国家关于西部大开发、中部崛起、支持东北等老工业基地等相关区域政策,对上述地区项目给予重点倾斜。地方补助投资根据各地自身财力和投资可能,相应做出安排。企业自有资金是现代农业示范项目投资来源的主体,企业自身应具备一定发展规模和资金实力。其他投资包括信贷资金、社会融资等,是项目建设投资的重要补充。
中央补助性投资主要体现政府投资的导向性和示范作用,重点用于基础性和公益性设施建设方面,主要内容包括:一是支持农业生产条件的改善,包括农产品生产基地建设、示范项目的水电路等基础设施建设等;二是农业优良品种的引进、繁育与技术推广等相关设施建设等;三是提高农业的组织化程度,包括支持农民专业合作组织和各类农民专业协会开展的项目建设等;四是农业社会化服务体系和市场体系建设,包括支持农业科技、信息、人才培训、质量检测及营销网络等基础设施建设;五是加强农业的多功能性和可持续发展方面的探索。
六、组织实施与项目管理
(一)管理办法。为规范现代农业示范项目管理,按照《中央预算内投资补助和贴息项目管理暂行办法》相关规定,国家发展改革委修订完善《现代农业示范项目管理办法》,加强对现代农业示范项目的指导和监督。
(二)省级负责。现代农业示范项目是国家发展改革委指导各地开展的一项综合性示范工程,项目性质为中央补助投资的地方建设项目。省级发展改革委是项目实施和监管的主体,对项目的任务、投资、建设和建后管护负全责,项目所在地发展改革委辅助做好相关管理和监督等职责。
(三)项目储备。在本规划的指导下,各地负责编制和完善本地区现代农业示范建设相关规划,制定本地现代农业示范项目管理相关实施办法,做好示范项目的前期准备工作,建立项目库,完善项目储备制度。项目需由有相应资质的工程咨询机构编制项目可行性研究报告。
(四)申报程序。按照公开、公平、公正的原则,项目立项和申报引入竞争机制,建立专家评审制度。省级发展改革委组织有关方面的专家对申报的项目进行评审,出具专家评审意见,并以此作为省级发展改革委审批项目的主要依据。项目决策严格执行科学化和民主化,推行项目公示制度。项目申报应包括以下材料:1、资金申请报告;2、项目可行性研究报告批复文件;3、专家评审论证意见;4、当地现代农业示范项目建设相关规划。
(五)计划下达。国家发展改革委收到各地上报的资金申请报告及相关文件后,审核各地上报的申请报告和项目建设方案,根据项目安排原则和投资可能,提出年度投资安排方案,确定年度投资计划具体项目,下达中央补助投资计划。已纳入年度计划的示范项目,要严格按照批准的项目建设内容和投资规模组织实施。项目实施过程中如需做必要调整,需按程序报批,任何单位未经批准不能自行改变项目的建设内容、建设规模和实施方案。
(六)资金管理。现代示范项目坚持多渠道筹集建设资金。地方政府需安排一定比例预算内投资或机动财力与国家补助资金配套。积极吸引其它渠道的资金投入现代农业建设。在确保国有资产保值增值和运行安全的基础上,鼓励各类经济实体参与项目建设,多渠道筹措项目建设资金。项目资金管理要设立专门账户,实行专款专用管理,有条件的地方要实行报账制等现代管理办法。国家投资主要用于基础设施建设等非经营性投资方面,经营性投资由项目法人自行筹措。
(七)监督检查。各地要切实对现代农业示范项目的监督检查工作,加强项目建设中招标投标、工程建设监理等制度建设。加强监督检查,一经发现问题,项目单位要及时整改,确保项目及早建成发挥效益。项目建成后,由省级发展改革委组织竣工验收,并提出验收报告。项目运行一年后,要及时组织项目的后评估。国家发展改革委将不定期地对项目实施和运行情况进行检查,并委托机构对项目建设情况、地方配套资金落实情况及项目资金使用情况进行专项稽查、审计,发现问题将严肃处理。
(八)建后管护。现代农业示范项目实行市场化运作、企业化经营的现代企业制度。项目正式运营后,要建立健全法人治理结构,积极探索新的管理运作方式,建立符合社会主义市场经济要求的运行机制。各地也要结合现代农业示范项目建设,加强对现代农业发展思路的研究,认真探索和总结本地区现代农业发展道路,促进现代农业建设健康发展。

依据《唐山市直管旧公房出售办法》和国家有关职工工龄规定,为保证公有住房出售工作的有序进行,维护国家利益和购房人的合法权益,对在旧公房出售过程中,职工购房工龄的有关问题作如下补充规定。
一、在职职工的购房工龄一律计算到1995年12月31日。已达到基本离退休年龄尚未办理离退休手续的,按国家规定的离退休年龄计算购房工龄,超过基本离退休年龄的必须提交审批手续。在职职工区分领导干部、一般干部、工人分别由组织、人事、劳资部门开具证明。
二、离退休职工的购房工龄计算到国家规定的离退休年龄,凭离退休证和身份证办理,离退休证上未注明离退休年龄的按管理权限由组织、人事、劳资部门开具证明。实际离退休年龄超过基本离退休年龄的必须严格履行延长离退休年龄审批手续,未经审批的不能计入购房工龄。
1.职工的基本离退休年龄:
(1)干部:男年满60周岁,女年满55周岁;
(2)工人:男年满60周岁,女年满50周岁。
2.有关延长离退休年龄的规定:
(1)从市级人大主任、政协主席、各民主党派和工商联主委岗位离退休的干部,其离退休年龄可在基本离退休年龄的基础上延长5年,不足5年的按实际,超过5年的按5年计。
(2)从市级人大副主任、政协副主席、各民主党派和工商联副主委岗位离退休的干部,其离退休年龄可在基本离退休年龄的基础上延长2年,不足2年按实际,超过2年的按2年计。
(3)从处级以上岗位离退休的女干部,凭延长离退休年龄的批文复印件(或手抄件),离退休年龄可延长到57岁,离退休时不足57岁的按实际计算,超过57岁的按57岁计算。
(4)高级技术人员凭《延长离退休年龄审批表》复印件(或手抄件),离退休年龄可在基本离退休年龄的基础上增加10年,实际延长的退休年龄不足10年的按实际计算,超过10年的按10年计算。
(5)中级技术人员凭《延长离退休年龄审批表》复印件(或手抄件),离退休年龄可在基本离退休年龄的基础上增加5年,实际增加的年龄不足5年的按实际计算,超过5年的按5年计算。
3.职工没到基本离退休年龄提前退休的,其购房工龄从参加工作之日起计算到实际退休年龄。
三、有关折算工龄的计算
(1)从事特别繁重体力劳动、高空、高温、井下和其他有毒有害工作,按国家规定给予增加折算工龄的职工,在计算购房工龄时,其折算的工龄只能抵顶提前离退休的年龄。既有折算工龄,又按国家规定的基本离退休年龄离退休的,不计算折算工龄。
(2)离退休职工增加的折算工龄少于提前离退休时间的,按实际折算工龄计算购房工龄;折算工龄超过提前离退休时间的,只将提前离退休时间计入购房工龄。
(3)职工在上述特殊环境工作期间,因上学、出国、借调、住院、休养等原因,脱离该岗位期间,不得计算折算工龄。
(4)在职职工1995年12月31日以前的折算工龄可计入购房工龄,但折算工龄最多不超过5年,计入购房工龄后不超过基本离退休年龄。
(5)职工的折算工龄按隶属关系分别由组织、人事、劳资部门,凭档案记载的有效内容开具证明,档案中无有效记载不得开具证明。
四、退职、辞职、开除公职人员购房工龄的计算:
1.按国发〔1978〕104号文件退职的职工在职期间的工龄可计入购房工龄。
2.经批准辞职的职工在职期间的工龄可计入购房工龄;自动离职的职工在职期间的工龄不计入购房工龄。
3.开除公职人员在职期间工龄不计入购房工龄。
五、关于学龄的认定
1.职工在省以上教育主管部门承认的中等专业学校学习期间的学龄可计入购房工龄。高中、职业中专、职业高中、技校、培训和进修性学校的学龄不计入购房工龄。
2.不与参加工作时间相连续的学龄不计入购房工龄。
3.有两种以上学历的学龄只计算与参加工作时间相连续的一种学龄。
4.与学龄相连续的工作时间不计入连续工龄,则该学龄也不计入购房工龄。
5.中专学历的学龄一律凭毕业证书、中等专业学校毕业生登记表原件或中等专业学校毕业生统一分配派遣证办理购房工龄认定,大专以上学历的学龄凭毕业证书或其他有效证件办理。
六、离休干部的购房工龄从离休证载明的参加革命工作时间算起。1940年以前在工矿企业工作的老工人,购房工龄从1948年开始计算,1948年以后参加工作的从实际参加工作时间计算购房工龄。

  the Government of the People's Republic of China have reviewed 
with
  sfaction the friendly relations existing between the two 
Governments
  peoples in recent years and agreed that a proper negotiated
settlement
  he question of Hong Kong, which is left over from the past, is 
con-
  ve to the maintenance of the prosperity and stability of Hong Kong
and
  he further strengthening and development of the relations between 
the
  countries on a new basis. To this end, they have, after talks 
between
  delegations of the two Governments, agreed to declare as follows:
  
  he Government of the People's Republic of China declares 
that to
  ver the Hong Kong area (including Hong Kong Island, Kowloon and 
the
  Territories, hereinafter referred to as Hong Kong) is the 
common
  ration of the entire Chinese people, and that it has decided to
resume
  exercise of sovereignty over Hong Kong with effect from 1 July
1997.
  
  he Government of the United Kingdom declares that it will restore
Hong
  to the People's Republic of China with effect from 1 July 1997.
  
  he Government of the People's Republic of China declares 
that the
  c policies of the People's Republic of China regarding Hong Kong 
are

  Upholding national unity and territorial integrity and taking 
account
  he history of Hong Kong and its realities, the People's 
Republic of
  a has decided to establish, in accordance with the 
provisions of
  cle 31 of the Constitution of the People's Republic of China, a 
Hong
  Special Administrative Region upon resuming the 
exercise  of
  reignty over Hong Kong.
  The Hong Kong Special Administrative Region will be directly
under the
  ority of the Central People's Government of the People's 
Republic of
  a. The Hong Kong Special Administrative Region will enjoy 
a high
  ee of autonomy, except in foreign and defence affairs which are 
the
  onsibilities of the Central People's Government.
  The Hong Kong Special Administrative Region will be 
vested with
  utive, legislative and independent judicial power, including 
that of
  l adjudication. The laws currently in force in Hong Kong will 
remain
  cally unchanged.
  The Government of the Hong Kong Special Administrative Region
will be
  osed of local inhabitants. The chief executive will be 
appointed by
  Central People's Government on the basis of the results of 
elections
  onsultations to be held locally. Principal officials will be
nominated
  he chief executive of the Hong Kong Special Administrative Region 
for
  intment by the Central People's Government. Chinese and 
foreign
  onals previously working in the public and police services 
in the
  rnment departments of Hong Kong may remain in employment. British 
and
  r foreign nationals may also be employed to serve as advisers or 
hold
  ain public posts in government departments of the Hong Kong 
Special
  nistrative Region.
  The current social and economic systems in Hong Kong will 
remain
  anged, and so will the life-style. Rights and freedoms, 
including
  e of the person, of speech, of the press, of assembly, of
association,
  ravel, of movement, of correspondence, of strike, of 
choice of
  pation, of academic research and of religious belief will be 
ensured
  aw in the Hong Kong Special Administrative Region. Private 
property,
  rship of enterprises, legitimate right of inheritance and 
foreign
  stment will be protected by law.
  The Hong Kong Special Administrative Region will retain the
status of
  ee port and a separate customs territory.
  The Hong Kong Special Administrative Region will retain the
status of
  nternational financial centre, and its markets for foreign 
exchange,
  , securities and futures will continue. There will be free 
flow of
  tal. The Hong Kong dollar will continue to circulate and remain
freely
  ertible.
  The Hong Kong Special Administrative Region will have 
independent
  nces. The Central People's Government will not levy taxes on the 
Hong
  Special Administrative Region.
  
  The Hong Kong Special Administrative Region may establish 
mutually
  ficial economic relations with the United Kingdom and other
countries,
  e economic interests in Hong Kong will be given due regard.
  Using the name of "Hong Kong, China", the Hong Kong 
Special
  nistrative Region may on its own maintain and develop 
economic and
  ural relations and conclude relevant agreements with states, 
regions
  relevant international organizations. The Government of the
Hong Kong
  ial Administrative Region may on its own issue travel 
documents for
  y into and exit from Hong Kong.
  The maintenance of public order in the  Hong  Kong 
Special
  nistrative Region will be the responsibility of the Government
of the
  Kong Special Administrative Region.
  The above-stated basic policies of the People's Republic of 
China

transfer of
  rnment in 1997, and with a view to the effective 
implementation of
  Joint Declaration, a Sino-British Joint Liaison Group will be set

  this Joint Declaration enters into force; and that it 
will be
  blished and will function in accordance with the provisions of 
Annex
  o this Joint Declaration.
  
  he Government of the United Kingdom and the Government of the

  blic of China declare that land leases in Hong Kong and other 
related
  ers will be dealt with in accordance with the provisions of Annex 
III

 ANNEX I: ELABORATION BY THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF 
CHINA OF ITS BASIC POLICIES REGARDING HONG KONG
  
  Government of the People's Republic of China elaborates the 
basic
  cies of the People's Republic of China regarding Hong Kong as set 
out
  aragraph 3 of the Joint Declaration of the Government of the 
United
  dom of Great Britain and Northern Ireland and the Government of 
the
  le's Republic of China on the Question of Hong Kong as follows:
  
  
  Constitution of the People's Republic of China stipulates in 
Article
  hat "the state may establish special administrative 
regions when
  ssary. The systems to be instituted in special administrative 
regions
  l be prescribed by laws enacted by the National People's 
Congress in
  light of the specific conditions." In accordance with this 
Article,
  People's Republic of China shall, upon the resumption of the 
exercise
  overeignty over Hong Kong on 1 July 1997, establish the Hong 
Kong
  ial Administrative Region of the People's Republic of China.  
The
  onal People's Congress of the People's Republic of China shall 
enact
  promulgate a Basic Law of the Hong Kong Special Administrative 
Region
  he People's Republic of China (hereinafter referred to as the 
Basic
  in accordance with the Constitution of the People's 
Republic of

  nistrative Region the socialist system and socialist policies

  Hong Kong Special Administrative Region shall be directly 
under the
  ority of the Central People's Government of the People's 
Republic of
  a and shall enjoy a high degree of autonomy. Except for foreign

  nce affairs which are the responsibilities of the Central 
People's
  rnment, the Hong Kong Special Administrative Region shall be 
vested
  executive, legislative and independent judicial power, including
that
  inal adjudication. The Central People's Government shall
authorise the
  Kong Special Administrative Region to conduct on its own 
those
  rnal affairs specified in Section XI of this Annex.

  ent persons. Judges shall be chosen by reference to their 
judicial
  ities and may be recruited from other common law 
jurisdictions. A

  ial Administrative Region acting in accordance with the
recommendation
  tribunal appointed by the chief judge of the court of final

  rtment, including the police department, and members of the 
judiciary
  all remain in employment and continue their service 
with pay,
  wances, benefits and conditions of service no less 
favourable than
  re. The Hong Kong Special Administrative Region government 
shall pay
  uch persons who retire or complete their contracts, as well 
as to
  e who have retired before 1 July 1997, or to their dependants,

  ions, gratuities, allowances and benefits due to them on terms

  urable than before, and irrespective of their nationality or

  Hong Kong Special Administrative Region Government may employ 
British
  other foreign nationals previously serving in the public 
service in
  Kong, and may recruit British and other foreign nationals 
holding
  anent identity cards of the Hong Kong Special Administrative
Region to
  e as public servants at all levels, except as heads 
of major
  rnment departments (corresponding to branches or 
departments at
  etary level) including the police department, and as deputy 
heads of
  of those departments. The Hong Kong Special Administrative 
Region
  rnment may also employ British and other foreign nationals as
advisers
  overnment departments and, when there is a need, may recruit
qualified
  idates from outside the Hong Kong Special Administrative 
Region to
  essional and technical posts in government departments, 
The above
  l be employed only in their individual capacities and, like 
other
  ic servants, shall be responsible to the  Hong  Kong 
Special
  nistrative Region Government.
